THE CONFUSION IN APGA CONTINUES…

Hon. Justice CC Thomas Adiele of the High Court of Abia State sitting at Umuahia will on February 5, 2019 deliver a ruling on an application filed by the Alex Otti faction of APGA on whether or not to grant a stay of execution of the judgment which sacked their faction as the authentic executive of the party in Abia State.
Yesterday, the parties to the suit were in court to formally adopt their written submissions after which the court adjourned for ruling.
Here is the background to the gist.
Sometimes in September 2018, Hon. Justice C U Okoroafor of the Abia State High Court delivered judgment declaring one Chief Barrister Prince Nnanna Ukaegbu as the authentic State Chairman of APGA in Abia State. That judgement sacked the executive led by one Rev. Ehiemere which represents the Alex Otti faction.
Naturally dissatisfied with the judgement, the Otti faction filed an application for stay of execution of the judgment before Justice Okoroafor who refused the application and advised them to proceed on appeal to the Court of Appeal.
Instead of proceeding to the Court of Appeal, the Otti faction filed a fresh application asking for a stay of execution of the judgment before Justice Adiele.
The two parties closed their arguments yesterday and adopted their written submissions. Counsel to the Nnanna Ukaegbu faction argued that a condition precedent to the granting of the relief of stay of execution, namely the filing of a notice of appeal, was not complied with as there is no such proof in the court’s file and urged the court to dismiss the application for lacking in merit.
Counsel to the Alex Otti faction claimed that they had filed a notice of appeal at the Court of Appeal and urged the court to grant the application.
The Nnanna Ukaegbu faction has Chief Chikwe Udensi as their Governorship Candidate while the Rev. Ehiemere faction has Alex Otti as their candidate.
Few weeks to election, APGA is not sure of who is their candidate.
While Alex Otti was in Ukwa East LGA for Campaign yesterday, Chikwe Udensi was in Umuahia inaugurating his Campaign Council.
